Miller was in court for a mental competency hearing in which Ninth Judicial Circuit Judge George Tyan heard from both the state and Miller's defense if he could stand trial. The hearing only lasted a few minutes.

Baxter's widow, FDLE Special Agent Sadia Baxter was also seen in court during the competency hearing. Sadia Baxter was a Kissimmee police officer until last month.

Howard and Baxter were responding last month to a call in the area of Palmway and Cypress streets that is known for drug activity when they were shot, police said.

Miller has entered a not guilty plea.

The next hearing is scheduled for Dec 12. Miller's trial is scheduled to begin in January.
