The arresting officer noted that Deegan's eyes were red, watery and glassy, and there was a strong odor of alcohol coming from the SUV.  The report said he was slurring his words, was clumsy when he got of the car, then couldn't find his wallet.

The report says he told officers he had two beers at a birthday party and was returning home.  An inventory of the car found three empty Budweiser cans, a full, unopened beer can in the passenger seat and a half-full 16-ounce can, cold to the touch, in the driver console, covered by a Texas A&M ball cap.

Police said his blood alcohol content was .181 and .179.
