Fleming Island man arrested, accused of destruction of property during Jan. 6 attack on Capitol

JACKSONVILLE, Fla. – Marcus Smith, a 47-year-old man from Fleming Island, was arrested Friday by the FBI and accused of being involved in the Jan. 6, 2021, U.S. Capitol riot.

He is accused of destruction of property and aiding and abetting, a felony. Smith was also accused of several misdemeanors, including entering and remaining in a restricted building, and engaging in physical violence on Capitol grounds, among others, according to the US Department of Justice.

Smith was pulled over by a Clay County deputy who was assisting the FBI with serving the federal warrant.

More than 1,265 people in the past 36 months have been accused of similar crimes related to the Capitol riot. Of those, 440 were accused of assaulting or impeding law enforcement officers at the scene of the riot.

Smith’s case is being further investigated by the FBI’s Jacksonville and Washington Field offices, and the investigation remains ongoing.

Smith is the 11th person from Northeast Florida to be charged in the insurrection. Nine of the 10 have been adjudicated and five got prison time.

Daniel Gray of Neptune Beach is awaiting sentencing. One man from St. Augustine died before his case was adjudicated.
