The justices did not comment Monday in refusing to hear the case of James Dailey, who was convicted in the killing of 14-year-old Shelly Boggio in the Tampa area in 1985. In addition, the other person convicted in Boggio’s killing now says he was solely responsible for her death. Only Dailey was sentenced to death, despite a lack of physical evidence tying him to the crime.

Daileys attorneys raised a series of issues, including arguments about what they said was newly discovered evidence in the case. Pearcy was convicted in the murder and sentenced to life in prison, while Dailey was sentenced to death. But the Supreme Court, in a 21-page ruling Tuesday, rejected the arguments about newly discovered evidence and other issues. Ron DeSantis in September signed a death warrant for Dailey and scheduled the execution for Nov. 7.

Commissioner of Agriculture Nikki Fried, a former public defender who now sits on the state clemency board, said she's torn on the death penalty. "There is no harm in making sure that there's more eyes on these cases and reviewing of all of the facts underlining it," said Fried. Another member, Chief Financial Officer Jimmy Patronis also seemed supportive of a clemency review when asked Tuesday. While two clemency board members said they would consider requiring the additional review, a third, the State's Attorney General Ashley Moody is skeptical.

Ron DeSantis last month signed a death warrant for Dailey and scheduled the execution for Nov. 7. Dailey's supporters have scurried in recent weeks to prevent his execution by arguing that he did not commit the murder. Along with Jung issuing the stay, Dailey's supporters have made a series of filings at the Florida Supreme Court to try to block the execution. The state objected to granting a stay, Jung wrote.

In the motion for a rehearing and clarification, Dailey's attorneys argued that the Supreme Court had improperly refused to consider a 2017 confession by Pearcy in the murder.

DeSantis scheduled a Nov. 7 execution for Dailey, who would be the third inmate put to death since DeSantis took office in January. The others were Gary Ray Bowles, who was executed in August for a 1994 murder in Jacksonville, and Bobby Joe Long, who was executed in May for a 1984 murder in Hillsborough County. Pearcy, now 64, was sentenced to life in prison for the murder, while Dailey received the death penalty. In releasing the death warrant, DeSantis' office included a 1994 resentencing order that provided grisly details about Boggio's death.
