Prosecutors ask to delay former JEA CEO’s sentencing trial, citing complicated legal issues

JACKSONVILLE, Fla. – Prosecutors filed a motion Thursday asking a judge to delay the sentencing trial for former JEA CEO Aaron Zahn, who was found guilty in a federal fraud and conspiracy case that would have landed the former executive millions if the utility company was sold.

A jury convicted Zahn of conspiracy and wire fraud in March.

He faces up to 25 years in prison. His sentencing is scheduled for June 18, but prosecutors want to postpone the date because of complicated legal issues addressed during the case and trial, according to their motion.

The prosecution said in the motion that there would be similar difficult legal issues involved with the sentencing as well.

The motion also called the process to complete the pre-sentencing report “pretty daunting.” The pre-sentencing report is a standard process compiled by a probation officer and is a standard part of the federal sentencing process.

According to the motion, Zahn does not oppose the request for a delay.

Prosecutors are suggesting to move the trial to late July. It will be the judge’s decision to make the final call.

There are also post-trial motions that are still pending – where Zahn asked for a judgment of acquittal or a new trial. Prosecutors recently responded to that motion, opposing their requests. The judge still has to rule on the motion.
